Change in Port Sydney ATV by-law makes citizens compliant for road use

A bylaw in Port Sydney that was making otherwise law abiding citizens scofflaws has been amended to allow the Highway Traffic Act to be used in its place.

Previously if you transited an ATV along Port Sydney’s main street you could potentially receive a fine from a municipal by-law officer for driving the popular four-wheeler along the roadway. Now it is legal to do, but it will be the OPP enforcing speed, drinking and riding, and helmet laws. And that is fine by local councillor Jason FitzGerald:

FitzGerald says it is about having a common sense approach to a situation where citizens could not do a normal, safe activity without breaching a by-law:

Port Sydney sees a huge increase of ATV riders over the summer months, travelling from cottages to the shoreline and even to run quick errands along the main street in town.
