Court of Appeal will hear Township of Muskoka Lakes' Bala Falls portage argument

The Ontario Court of Appeal will hear the Township of Muskoka Lakes’ appeal on an issue in the Bala Falls controversy. The Township’s request to get a judicial review that sought protection of the
public’s right to portage across public lands between Lake Muskoka and the Moon River and to access the Moon River for recreational purposes from those public lands, had been refused by the Province’s Divisional Court. The Court of Appeal will now consider the strength of the historic rights afforded to the public to enjoy Criwn lands and use of nearby waters. The appeal will be heard later this year and could impact the controversial hydroelectric Bala Falls project proposed by
Swift River Energy Ltd.
